Expectations not fulfilled
Industry associations, including the ZVEI, are critical of the EU Data Act. The Data Act falls short of its potential, they say.
Wolfgang Weber, Chairman of the ZVEI Management Board, on the conclusion of the political trilogue negotiations on the EU Data Act:
"The Data Act falls short of the possible potential of the actual goal of strengthening the European economy in global competition through more data use and data sharing. This is because a significant part of the value creation network, namely the suppliers of the components and therefore the actual data producers, are not taken into account. It also remains to be seen whether the protection of trade secrets can be effectively safeguarded. If this is not the case, Europe will be at a major competitive disadvantage. The EU has chosen speed over thoroughness. There are fears that much of the content is not sufficiently clearly defined and that new legal uncertainties will be created for our member companies that will prevent rather than promote data sharing. An open-ended review of how and whether the planned measures will achieve the desired effects is needed in a timely manner. In addition, sector-specific regulation is needed, and this time the industry must be involved in its development at an early stage to ensure that the objectives described in the Data Act are achieved."
