EU Commission wants to protect victims of artificial intelligence

According to the EU Commission, anyone who suffers damage due to artificial intelligence should be able to claim compensation more easily in future. According to the Commission, this should also increase confidence in new technologies.

To this end, existing directives are to be revised and combined with the regulations for artificial intelligence. The Brussels authority presented a corresponding draft law on Wednesday.

Artificial intelligence (AI) refers to computer programs that are able to learn and improve over time. Self-driving cars, for example, try to predict the behavior of other road users.

The current EU regulations on product liability are almost 40 years old and need to be modernized, according to a Commission communication. "The aim is to create legal certainty for companies and ensure that consumers are well protected in the event of problems", it continued. To this end, there should be uniform rules that give consumers access to information, for example.

This should give injured parties the right to view AI data and logs and use them as evidence. The new regulation would also require AI providers to prove that their technology was not responsible for the accident in the event of a claim.

Appropriate standards of protection for EU citizens are the basis for consumer trust and therefore for successful innovation, said EU Justice Commissioner Didier Reynders. "New technologies such as drones or AI-powered delivery services can only work if consumers feel safe and protected." The draft law will make the existing legal framework fit for the realities of digital change. The Commission's proposal still has to be adopted by the European Parliament and the EU member states.
